1. Acceptance of Terms
By downloading, installing, or using NORDR (the “App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
2. License Grant
NORDR is licensed to you, not sold. Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to use the App on your device for personal, non-commercial purposes related to surf forecasting and ocean conditions.
3. Safety Disclaimer
NORDR is an information tool, not a safety device. The ocean is dangerous. You are responsible for your own safety.
NORDR provides surf forecasts, weather model output, buoy observations, and machine-learning predictions. All of these are estimates. They can be wrong, delayed, or unavailable. Conditions on the water can change suddenly and may differ significantly from any forecast or model output shown in the App.
Never enter the water based on the App alone. Always assess the conditions yourself, check official marine warnings, surf within your ability, and follow local rules and rescue services. NORDR is not a substitute for local knowledge, lifeguards, coast guard advisories, or your own judgment.
NORDR is not a navigation aid and must not be used for navigation, vessel routing, or any commercial maritime decision.
4. Forecast Accuracy
NORDR aggregates data from third-party sources (including Open-Meteo, NOAA buoys, and machine-learning models). We do not guarantee:
- That forecasts will be accurate, complete, or available
- That third-party data feeds will remain online or unchanged
- That predictions will match actual conditions on the water
- That the App will detect or warn about hazardous conditions
5. Subscription Terms and In-App Purchases
NORDR Pro
NORDR offers optional premium features through NORDR Pro. The free app remains usable without a purchase, and any paid access is only activated after you confirm the purchase through Apple’s App Store purchase sheet.
Available offers may include:
- Monthly: an auto-renewing monthly subscription
- Annual: an auto-renewing annual subscription, which may include a free trial when shown in the App Store purchase sheet
- Crew: an auto-renewing annual subscription intended for family or crew access where Apple Family Sharing is available and enabled
- Founder: a one-time lifetime in-app purchase for permanent NORDR Pro access, subject to availability
Price, Payment, and Renewal
Current prices, billing periods, trial eligibility, taxes, and local currency are displayed in the App before purchase and in Apple’s App Store purchase sheet before you confirm. Payment is charged to your Apple Account when you confirm the purchase.
Monthly, annual, and crew subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple Account may be charged for renewal within 24 hours before the end of the current period.
The Founder lifetime purchase is not a subscription. It is charged once, does not renew, and does not appear in Apple’s subscription-management screen.
Cancellation and Refunds
You can cancel an active subscription at any time through Apple:
- Open Settings → [Your Name] → Subscriptions → NORDR → Manage
- Or use Apple’s subscription-management page: https://apps.apple.com/account/subscriptions
Cancellation stops future renewals but does not remove access already paid for during the current billing period. Refund requests, eligibility, and payment disputes are handled by Apple according to Apple’s policies and applicable law.
6. User Responsibilities
You agree to:
- Use the App only for lawful personal use
- Not reverse-engineer, modify, or redistribute the App
- Not abuse the forecast backend (excessive automated requests, scraping, denial-of-service)
- Accept responsibility for your own safety in and around the water
7. Limitation of Liability
To the maximum extent permitted by law, Pelagic Labs and the NORDR team are not liable for:
- Inaccurate, missing, or delayed forecast data
- Decisions you make based on App information, including decisions to enter or remain in the water
- Personal injury, property damage, or loss of life arising from use of the App
- Service interruptions of the forecast backend or upstream data sources
- Any indirect, incidental, special, or consequential damages
8. Data & Privacy
NORDR is built privacy-first. See our Privacy Policy for full details on data handling, location use, and your rights.
9. Intellectual Property
The App, including all text, graphics, logos, icons, and code, is owned by Pelagic Labs and protected by copyright. Forecast data is provided by third-party sources under their respective licenses. You may not reproduce, distribute, or transmit App content without permission.
10. Termination
We may terminate or suspend access to the App if you violate these terms or abuse the forecast backend. Termination does not affect data already on your device, which you can remove by uninstalling the App.
11. Changes to Terms
We may update these Terms of Use at any time. Changes take effect when posted on this page with an updated “Last Updated” date. Continued use of the App after changes means you accept the updated terms.
12. Governing Law
These terms are governed by the laws of Belgium, where Pelagic Labs is registered, without regard to conflict of law principles.
