1. Acceptance of Terms
By downloading, installing, or using NGA - Anchor Alarm (the “App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
2. License Grant
NGA is licensed to you, not sold. Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to use the App on your device for personal boating use.
3. Anchor Alarm Disclaimer
NGA is an aid, not a replacement for seamanship.
NGA is not a replacement for anchor checks, weather judgment, proper watchkeeping, safe boating practice, or your own decision-making. You remain responsible for your boat, crew, equipment, anchorage, route, and actions on the water.
4. User Responsibilities
You are responsible for setting up and using NGA correctly.
- Set the correct anchor point
- Set an appropriate radius and swing arc
- Keep location permission enabled during an active watch
- Keep notifications, device power, volume, and audio routing in a usable state
- Confirm the phone alarm can be heard where it matters
- Continue normal anchor checks and watchkeeping
5. Operational Limits
NGA depends on device and platform conditions that can change or fail.
- GPS accuracy can vary or degrade
- iOS background execution can affect timing
- Notifications can be delayed, blocked, silenced, or misconfigured
- Apple Watch, Live Activity, Dynamic Island, and iCloud status can lag or become unavailable
- Battery level, device temperature, device damage, speaker state, network conditions, and permissions can affect behavior
6. Primary Alarm
The phone remains the primary audible alarm. Apple Watch, Live Activity, Dynamic Island, and remote watch are companion surfaces. They are useful for status and controls, but they are not substitutes for the phone alarm.
7. Remote Watch
Remote watch is optional and off by default. It uses your private iCloud database when enabled. Remote watch is a companion status surface, not emergency monitoring. Pelagic Labs does not operate a monitoring center and does not watch your anchor alarm for you.
8. No Emergency Service Monitoring
NGA does not contact emergency services, coast guard services, marina staff, rescue services, or any other responder. If you need help, contact the appropriate service yourself using the normal emergency or marine communication channels available to you.
9. No Warranty
NGA is provided as-is and as available. Pelagic Labs does not guarantee uninterrupted, timely, accurate, or error-free operation. NGA may miss an event, alert late, show stale information, or fail because of GPS, iOS, notifications, Apple Watch, Live Activity, iCloud, battery, device, permission, or network conditions.
10. Use at Own Risk
You use NGA at your own risk. To the maximum extent permitted by law, Pelagic Labs and its creators are not liable for losses, damage, injury, grounding, dragging, collision, missed alarms, late alarms, data loss, or decisions you make based on the App.
11. Data and Privacy
Your location and history stay on device unless you enable remote watch. See our Privacy Policy for full details on location handling, iCloud remote watch, notifications, and deletion.
12. Intellectual Property
The App, including all text, graphics, logos, icons, and code, is owned by Pelagic Labs and protected by applicable intellectual property laws. You may not copy, redistribute, modify, or reverse-engineer the App except where allowed by law.
13. Changes to Terms
We may update these Terms of Use at any time. Changes take effect when posted on this page with an updated Last Updated date. Continued use of the App after changes means you accept the updated terms.
14. Governing Law
These terms are governed by the laws of Belgium, where Pelagic Labs is registered, without regard to conflict of law principles.
